Arraingment in manslaughter

A Harrah man has waived his preliminary hearing on a manslaughter charge or in the alternative negligent homicide after his four-yearold son reportedly jumped from his pickup truck and was run over by the vehicle.

A formal charge of second degree manslaughter, a felony, or in the alternative negligent homicide, was filed in Lincoln County District Court Aug. 3, 2023 against Randy Eugene Orr, 50.

Appearing before District Judge John Canavan, Orr waived his preliminary hearing. The judge received the waiver and scheduled his arraignment for 9 a.m. on May 28.

Count 1, second degree manslaughter, accuses Orr on April 20, 2023 of causing the death of L.O. through culpable negligence of allowing four-year-old L.O. to ride on the runner of the exterior of his vehicle while Orr was driving, resulting in L.O. jumping off and being run over by the defendant.

The alternative count, negligent homicide, a misdemeanor, charges Orr with causing the death of L.O. as a proximate result of Orr’s driving a Ford-150 in the city of Harrah in reckless disregard of others by letting 4-year-old L.O. ride on the runner of the exterior of his vehicle while he was driving, resulting in L.O. jumping off and being run by the defendant.

Oklahoma Highway Patrol Trooper Chad Pape, with the Traffic Homicide Unit, states in an affidavit filed in the case that on April 20 of this year he was informed of an incident that had occurred at a private residence in Lincoln County where a child had been run over by a vehicle and that the child had been pronounced deceased at the scene.

Pape said he parked his patrol unit at the intersection of 1022 Road and 3300 Road in Lincoln County. He further stated he spoke with Trooper Caleb Scott who informed him the incident had occurred at a residence further to the west but that the father, Randy Orr, had begun an attempt to drive the victim, Layton Orr, to the hospital but was told to pull over by emergency personnel while on the phone with 911.
