A Chandler woman’s case motion to have her 30 years in prison for conviction of two felonies modified has been denied by a District Judge.
Formal charges were filed in Lincoln County District Court on Sep. 21, 2022 against Destiny Ann Lowe, 39, and her husband Robert Wayne Lowe, 41.
Robert Lowe was sentenced in 2023 to multiple life terms and his wife also was sentenced on sex-related crimes with a minor.
They were arrested by Lincoln County deputies.
Both had entered blind pleas of guilty. At a review last week before District Judge Sarah Bridge Destiny Ann was seeking to her prison term modified.
At the conclusion of a hearing that included witnesses, court exhibit and arguments heard, Judge Bridge denied her motion.
Assistant District Attorney Rachel Thompson handled the case for the state and Shelley Levisay was Destiny Ann’s attorney.
Robert Lowe, who also had entered blind guilty pleas to six counts of lewd acts with a child under 16, appeared Dec. 19 before District Judge John Canavan for sentencing.
The judge found him guilty on counts 1 through 6 and ordered a sentence of life in the Department of Corrections on each count and to pay court costs.
Destiny Ann entered the blind guilty plea on Oct. 10, 2023 before Judge Canavan.
Appearing before Judge Canavan on Dec. 19, the judge found her guilty as charged on Count 1, enabling child abuse and sentenced her to five years in the Department of Corrections, assessed her a $500 fine, a $100 VCA, and court costs.
On Count 2, he also found her guilty, handed her a sentence of 25 years in DOC, a $500 fine, $100 VCA, court costs and ordered the sentences to run consecutively with each other. She is to be given credit for time served and is to report to the Court Clerks’ Office within 180 days of release.
A pre-sentence investigation had been requested and ordered.
Originally, Robert Lowe faced four counts of lewd acts to a child under 12 years old and Destiny Lowe was charged with a single count of enabling child sexual abuse.
Those charges were later amended to include additional counts.
At the conclusion of their preliminary hearing on Jan. 20 this year, they were bound over to stand trial.
Robert Lowe was facing a total of seven counts of lewd acts with a child under 16 and Destiny Lowe has admitted one count of enabling child sexual abuse and one count of lewd acts with a child under 16.
As his jury trial was about to begin with Associate District Judge Sheila Kirk presiding, Lowe waived his right to a jury trial and entered the blind guilty plea on Oct. 17.
The judge received the plea and found him guilty.
He requested a pre-sentenced investigation and a PSI was ordered.
Robert Lowe was charged with fourth degree arson and Destiny Lowe had been granted an EPO against Robert Lowe. Court records show the EPO was dismissed by Special Judge Emily Mueller at Destiny Lowe’s request.
His fourth degree arson charge was dismissed on Jan. 20 this year.
According to a probable cause affidavit filed in the case, Lincoln County Deputy Sheriff Cody Coleman was notified about a social media post and he began an investigation.
Deputy Coleman was later joined in the probe by Lincoln County Detective George Kelly Coleman, Deputies Jimmy Brown and Shawn Stewart, Vanessa Parsons with the One Safe Place Center and the Department of Human Services.
Deputies learned the DHS already had an open case going in the matter.
