A Chandler man originally facing three felony charges related to trafficking, cultivation and maintaining a place for keeping and selling illegal drugs has pleaded guilty to one amended count and the other two have been dismissed.
Formal felony charges were filed in July in Lincoln County District Court against Stephen Anthony Ormsby, 37.
Ormsby appeared before District Judge Cindy Ashwood recently for his arraignment. The state moved to amend Count 1 to possession of CDS with intent. Court records show the charge was amended by interlienation to possession of CDS with intent.
As the result of plea bargain agreement Ormsby pleaded guilty. Both the state and Ormsby waived a pre-sentence investigation and Judge Ashwood found him guilty as charged. She handed him a five-year suspended prison sentence, assessed him a $300 fine, a $100 VCA and court costs.
She also ordered him to perform 40 hours of Community Service within six months, pay 991C fees and ordered the sentence to run concurrent with an Indiana case. She then dismissed Counts 2 and 3 wth cost to the defendant and he was placed on supervised probation with the Department of Corrections.
He was told to report to the probation office and the Court Clerk’s Office.
In count 1, Ormsby was accused of knowingly possessing an excessive amount of approximately 42 pounds of processed marijuana, a controlled dangerous substance in Schedule 1 of the Uniform Controlled Dangerous Substance Act.
Count 2 had charged him with knowingly cultivating marijuana, botanically known as cannabis sativa L., from which a controlled dangerous substance may be derived, located in Chandler in Lincoln County that belonged to him.
