A McLoud area man who has pending felony counts now faces felony kidnapping and domestic assault and battery by strangulation charges in addition to them. A misdemeanor charge was also filed against him.
Eliah Lively, 24, was formally charged Sep. 15 in Lincoln County District Court with the kidnapping and domestic assault and battery by strangulation counts. A $25,000 bench warrant was issued for his arrest and the same day the warrant was returned and filed, court records show.
The misdemeanor count is domestic assault and battery in presence of a minor. He made his initial on Sep. 21.
On Aug. 22, he was charged in Lincoln County District Court with felony possession of a stolen vehicle. His bond was set at $7,500.
In the kidnapping charge, Lively is accused on Sep. 10, 2023 of forcibly confining Summer Lively in a van in Lincoln County without lawful authority and with the intent to cause her to be confined against her will.
Count 2, domestic assault and battery by strangulation, he allegedly strangled the victim, Summer Lively who he is married to by choking her with the intent to cause her bodily harm.
In Count 3, the misdemeanor, he is accused on the same date of assault and battery on Summer Lively by pushing her up the stairs by her hair and biting her with force and violence in the presence of their minor children.
