ALuther man will appear for a pre-preliminary hearing on July 23 in an assault and battery case.
Willie Cowan, 40, was charged with one felony count of domestic abuse assault and battery on May 13 after an incident with his roommate that occurred on May 8, according to the court filing.
District Attorney Adam Panter filed supplemental information, showing that Cowan has several previous convictions going as far back as 2011. He was also previously convicted of misdemeanor domestic assault and battery in Oklahoma County in 2017.
According to the probable cause affidavit, Dep. Marcus Peters with the Lincoln County Sheriff’s Office was dispatched to a residence with a Luther address within the county on May 8, in reference to an assault report. Upon arrival, he spoke with the reporting party, who informed him that she had received a text and phone call from her brother’s girlfriend that her son (Cowan) had assaulted the victim. The sister reported that her brother was disabled, according to the affidavit.
Dep. Peters then went to the home of the victim, where he lived with his girlfriend and her son. On the way there, the Comm CenterreportedthatCowan had an active $50,000 felony warrant out of Pottawatomie County. Peters was met by the girlfriend, who told him that her son had assaulted her boyfriend, the report said.
Peters then met with the victim, noting fresh lacerations to his face. The couple stated that Cowan woke up from the couch and began arguing with his mother, telling her that her boyfriend couldn’t stay. He then went into the bedroom where the victim was and beat him with an aluminum broom. Peters took photos and written statements from the two. As Cowan was not present at the residence, he told the couple to contact the Sheriff’s Office if Cowan returned.
On May 9, Peters, Dep. Vickery and Dep. Gregory Smith returned to the residence to serve the felony warrant on Cowan from Pottawatomie County. They saw a silver car behind a trailer that hadn’t been there earlier. Cowan’s mother met them at the front door, but stated she hadn’t seen him and didn’t know if he was on the property. Peters asked about the shed, and she said that Cowan sometimes stayed there, according to the affidavit.
The three entered the shed and found Cowan with a woman, along with marijuana, multiple small white bags, a glass smoking pipe with a white crystalline substance in it, a digital scale, and a plastic container with a white residue and a bullet inside, the report said. When questioned, Cowan stated he only smoked marijuana and that the glass pipe was for smoking methamphetamine and belonged to his mother.
The affidavit said that Cowan was then taken into custody for the felony warrantfromPottawatomie County, as well as domestic assault and battery, and transported to the Lincoln County Jail without incident.
