Prisoner charged in assault on county officer

An Agra woman who reportedly had been arrested earlier in the day and was in a detox cell of the jail, faces an assault and battery charge on an officer.

Maggie June Capps, 18, was formally charged on Oct. 14 in Lincoln County District Court with the felony.

Capps made her initial appearance on Oct. 14 before Special Judge Emily Mueller. The judge set a pre-preliminary hearing for her at 1:30 p.m. Nov. 4.

Capps was already in jail after being arrested for two misdemeanors that day. Those charges included calling 911 with a false alarm and resisting arrest. Her initial appearance was made the same day as on the felony charge and the matter was set for the same time and day as the felony as well.

The felony charge accuses Capps of on Oct. 7 at the Lincoln County jail of throwing her body with force and violence against Detention Officer Charity Bennett, by pushing Bennett without justifiable or excusable cause.

Lincoln County Deputy Sheriff George Kelly Coleman stated in an affidavit that he was asked to assist jail personnel as Bennett was about to deliver a lunch tray to Capps in the back detox cell.

Coleman said he was asked to stand out of sight of the back detox unit while the door was opened to deliver the trays.

Detention Officer Kenny Smith unlocked the detox door electronically and as Bennett opened the door, Capps reportedly put her hands up to take the tray but ran into Bennett.

Capps attempted to push Bennett out of the way but Bennett pressed Capps against the door and held her until the deputy could assist.

Coleman said he took Capps by the wrist with his hand and her arm with the other hand, placed her on the mat on the floor inside the back detox door in a controlling posture.

Bennett closed the door. Capps was booked in on the Assault and Battery complaint.
