A Chandler woman has pleaded guilty to several felony charges, among them two for assault and battery upon a police officer, and has been handed deferred terms on each.
Cheryl Manning, 46, was formally charged in Lincoln County District on Oct. 12, 2022 with two counts of assault and battery upon a police officer and placing bodily fluids on a police officer, all felonies.
She also was charged with drinking an alcoholic beverage in a public place.
On Sep. 28 this year, she waived her preliminary hearing. Special Judge Emily Mueller scheduled her arraignment for 9:30 a.m. Oct. 31.
The defendant and state waived right to arraignment in 30 days.
Appearing before District Judge John Canavan on Oct. 31, Manning, upon state’s recommendation as a result of a plea bargain, pleaded guilty and the judge handed her five-year deferred sentences on each of the four counts to run concurrent with each other.
The judge also handed Manning $100 judicial assessments, $100 VCA and court costs on each of the four charges. He ordered she obtain a Mental Health Evaluation and complete all recommended requirements, pay 991C fees and be placed on supervised probation with the Oklahoma Court Services.
Manning is to report to the probation office and Court Clerk’s Office.
Assistant District Attorney Rachael Thompson handled the case for the state and Manning’s defense attorney was Shelly Levisay.
In Count 1, Manning was accused on Oct. 11, 2022 on the roadway near 930538 S. 3400 Road in Lincoln County of intentionally kicking Chandler Police Chief Matt Mattheyer while he was performing his duty to arrest her for being intoxicated in public.
Count 2 charged Manning on the same day and place of intentionally kicking Chandler Police Lt. Dax Phipps while he was attempting to arrest her for being intoxicated in a public place.
In Count 3, Manning was accused on the same day and place of spitting saliva on Phipps as he was trying to arrest her for public intoxication.
The misdemeanor charged her with drinking a Smirnoff Green Apple alcoholic beverage and being intoxicated at that same location.
In a probable cause affidavit, Lincoln County Deputy Sheriff Jimmy Brown stated he was dispatched to East 930 Road and South 3400 Road, one-half mile south of Chandler near the residence at 930538 S. 3400 Road shortly after 3:30 p.m. on Oct. 11 to a single vehicle crash.
He reported Comm Center advised the driver was intoxicated and when he arrived Mattheyer and Phipps had a female on the ground in handcuffs. He stated in the affidavit the female was yelling, screaming and cussing trying to get up saying she wanted to fight the two officers.
Brown said the vehicle was on its top when he arrived and Phipps asked Manning had she been drinking and she responded that she had. She told Phipps when asked how much, that she had too much to drink, according to the affidavit.
She acknowledged to Phipps she had consumed a sixpack of Smirnoff ice green apple.
Brown stated Deputy Christopher Hyde arrived on the scene and assisted him in putting Manning in the back of his patrol unit. Brown transported her to Lincoln County Jail in Chandler without incident.
