A man from Kendrick is awaiting sentencing after he entered blind pleas on charges filed against him earlier this month.
Oscar Dee Trey Third Messer, 37, entered the pleas before Lincoln County District Judge Cynthia Ferrell Ashwood on March 9. She set his sentencing for 1:30 p.m. on April 13.
The judge ordered a pre-sentence investigation.
Messer was formally charged on March 1 with escape from arrest or detention, a felony, and petit larceny.
The escape count accuses Messer of escaping from the custody of Lincoln County Sheriff’s Deputy Mark Kelley after being arrested on a warrant on Jan. 20 of this year.
The petit larceny charge, a misdemeanor, alleged he stole a pair of handcuffs belonging to the Sheriff’s Office the same day.
According to a probable cause affidavit, Kelley went to 349637 C Street in Kendrick to take a theft report. Kelley said he went to take a check fraud report from Debra Messer who claimed had been committed by Messer.
She advised he was asleep upstairs. Kelley was informed by Dispatch that Messer had an outstanding warrant out of Lincoln County.
The deputy placed Messer under arrest for the warrant, put him in handcuffs with them behind his back and Messer was placed into the backseat of the patrol car and the door locked.
Kelley went back into the house to give Debra a statement form. When he returned to the car, Messer was gone, the affidavit states and Messer had taken the officer’s handcuffs with him.
The deputy said Messer left his shoes and hat in the back seat. Six officers spent an hour searching for the escapee but they were unable to locate him, the affidavit states.
