Federal indictment for Sparks man

A federal grand jury has indicted a Sparks man who already is sitting in the Lincoln County Jail facing three felonies that were filed against him last July.

The grand jury recently issued a four-count indictment against Stephen Charles Graham, 61.

Count 1 accuses him on July 12, 2023 of possession of methamphetamine with intent to distribute. He reportedly possessed with intent to distribute 50 grams or more of a mixture of substance containing a detectable amount of methamphetamine, its salts, isomers or salts of its isomers.

In Count 2 Graham is accused on the same date of felon in possession of a firearm, having previously been convicted of a crime punishable by imprisonment of a term exceeding one year.

The indictment states he possessed a CBC, Companhia Braziliera De Cartuchos, model 151, 20-gauge, short-barreled shotgun, which was in and affecting interstate or foreign commerce in that it had previously crossed state lines to reach Oklahoma.

Count 3 alleges Graham, on the same date, had in possession that same weapon which was an unregistered firearm made from a shotgun that was modified to have an overall length of less than 26 inches and a barrel of less than 18 inches in length.

It was not registered with the National Firearms Registration and Transfer Record, the indictment states.

In Count 4, Graham is accused on July 12, 2023 of possession of a short-barreled shotgun in furtherance of a drugtrafficking crime.

The indictment states he was in possession of the same shotgun as described in the other counts in furtherance of drug trafficking, possession of methamphetamine with intent to distribute.

The indictment further states that upon conviction of Count 1, Graham shall forfeit to the United States any property derived from any proceeds obtained directly or indirectly as a result of the offense and any property used or intended to be used in any manner or part to commit or to facilitate an offense.

It says upon conviction of the offenses alleged in Counts 2 and 4, he shall forfeit to the U.S. any and all firearms and ammunition involved in the commission of the offenses.

Upon conviction of Count 3, Graham must forfeit to the U.S. any firearms involved in committing that offense.

Graham was formally charged in Lincoln County District Court July 18, 2023 with trafficking in illegal drugs (methamphetamine), possession of firearm after former conviction of a felony; and possession of a Controlled Dangerous Substance (marijuana).

He was arrested at his residence in Sparks on July 12 last year by Lincoln County deputies.

At the conclusion of his preliminary hearing in December, he was bound over to stand trial.

During his arraignment before District Judge John Canavan, he pleaded not guilty and the judge set him for the felony disposition docket at 9 a.m. May 7.
