Guilty plea in kidnapping

A man facing felony kidnapping and domestic assault and battery by strangulation charges in addition to other felonies, has pleaded guilty and has been sentenced. A misdemeanor charge was also filed against him.

Eliah Lively, 24, was formally charged Sep. 15, 2023 in Lincoln County District Court with the kidnapping and domestic assault and battery by strangulation counts. A $25,000 bench warrant was issued for his arrest and the same day the warrant was returned and filed, court records show.

The misdemeanor count is domestic assault and battery in presence of a minor.

He made his initial on Sep. 21.

During a reappearance before Special Judge Emily Muller recently, Lively waived a pre-sentence investigation, waived his preliminary hearing and waived the two judge rule and jurisdiction.

On the recommendation of the state as a result of a plea bargain, Lively entered guilty pleas and the court found him guilty as charged.

On Count 1, Judge Mueller sentenced him to 10 years in the custody of the Department of Corrections with all the time suspended except the firs two years, a $100 fine, a $100 VCA and court costs.

On Count 2, he was sentenced to three years in the custody of DOC with all time suspended except the first two years, a $100 fine, $100 VCA and court costs; and on Count 3 he was sentenced to one year in the custody of the Lincoln County Jail, $100 fine, $100 VCA and court costs.

He is to receive credit for time served and to attend a Batterers Intervention program.
