A Chandler man who pleaded guilty Nov. 2 to charges filed against him in September, was arrested a few hours later and faces a new felony.
Brandon Lee Burns, 33, was formally charged Nov. 5 in Lincoln County District Court with assault and battery with a dangerous weapon.
He was arrested by Chandler Police Lt. Dax Phipps just before 3:30 p.m. on Nov. 2.
Burns is now accused of on Nov. 2 of attempting to do corporal injury to Charles Munn with a steel spike with the intent of harming him.
Earlier the same day that he was arrested for the new charge, he had appeared before District Judge Cindy Ashwood.
He pleaded guilty, as the result of a plea bargain agreement, to assault and battery with a dangerous weapon after former felony conviction and unlawful possession of marijuana.
On Count 1, Judge Ashwood handed Burns a three-year deferred sentence, gave him a $300 judicial assessment, a $100 VCA and court costs.
On the second count, she gave him another three-year deferred sentence, $100 judicial assessment, $100 VCA and court costs with the sentences to run concurrently. The judge also ordered Burns to perform 40 hours of community service within six months, obtain a drug and alcohol assessment and complete all recommended followup treatment.
She further ordered Burns to have no contact with Charles Munn during probation. Munn is the same person he is charged with assaulting with a dangerous weapon on Nov. 2.
Burns was placed on supervised probation with the Oklahoma Court Services. He was to report to the probation office and the Court Clerk’s office by the end of hours on Nov. 5, the same day the new charge was filed against him.
Associate District Judge Sheila Kirk set a $2,000 bond for Burns on the new charge with the stipulated condition he have no contact with the victim. He made his initial appearance Nov. 8 and was ordered to reappear Nov. 15.
Judge Kirk scheduled him to reappear on Nov. 22. On that date, she further ordered him to reappear on Dec. 2 for a pre-preliminary hearing.
Last week, Special Judge Emily Mueller scheduled the matter for attorney review at 1:30 p.m. Dec. 16.
