No contest plea in homicide

A Harrah man facing a manslaughter charge or in the alternative negligent homicide has pleaded no contest to the lesser count and has been fined.

A formal charge of second degree manslaughter, a felony, or in the alternative negligent homicide, was filed in Lincoln County District Court Aug. 3, 2023 against Randy Eugene Orr, 50.

The charge was filed after his four-year-old son had reportedly jumped from Orr’s pickup truck and was run over by the vehicle. His son died from those injuries.

Appearing recently for his arraignment before District Judge John Canavan, Orr waived the reading and the state moved to dismiss the manslaughter case without costs.

Upon the state’s recommendation as the result of a plea bargain, Orr entered a no contest plea to negligent homicide. The plea was received and the court found Orr guilty of the misdemeanor of negligent homicide.

Judge Canavan assessed him a $500 fine, a $1,000 VCA and court costs.

The judge dismissed the manslaughter count without costs and Orr was ordered to report to the Court Clerk’s Office.

Assistant District Attorney Rachel Thompson represented the state and Orr was defended by attorney Irven Box The alternative count, negligent homicide, a misdemeanor, charges Orr with causing the death of L.O. as a proximate result of Orr’s driving a Ford-150 in the city of Harrah in reckless disregard of others by letting a 4-year-old ride on the runner of the exterior of his vehicle while he was driving, resulting in the 4-year-old jumping off and being run by the defendant.

Oklahoma Highway Patrol Trooper Chad Pape, with the Traffic Homicide Unit, states in an affidavit filed in the case that on April 20 of this year he was informed of an incident that had occurred at a private residence in Lincoln County where a child had been run over by a vehicle and that the child had been pronounced deceased at the scene.
