A man from Depew faces a felonious first degree robbery charge after allegedly stealing a firearm from a Stroud resident last fall.
Russell Ted Foutch, 31, was formally charged in Lincoln County District Court on March 2 of this year. A $25,000 bench warrant was issued by Special Judge Emily Mueller for Foutch who was later arrested and appeared in court before the judge on March 5, records show.
He also was charged on March 1 of this year with the criminal misdemeanor of controlled dangerous substance.
Judge Mueller set a pre-preliminary hearing on the robbery count for Foutch at 1:30 p.m. on April 1 and also set a reappearance on the misdemeanor for Foutch at the same time, according to court records.
In the felony complaint, Foutch is accused of stealing a gun by means of force and fear from John Cushing on Sep. 4, 2020 at a Stroud residence.
In a probable cause affidavit, Stroud Police Officer Wade Martin reports he was advised by dispatch that Cushing came to the Police Department needing to file a report on a stolen firearm.
Martin says in the affidavit that Cushing advised him that Foutch walked into his house while Cushing was on the phone and told him that if he didn’t let him have the gun that he and another subject named Browny would kick the door in and get it.
The officer stated that Cushing told him the gun was sitting beside him on the couch and that Couch grabbed it and left.
