A Chandler police officer has arrested a Prague man for two alleged felonies committed against an off-duty Payne County Deputy Sheriff and his wife.
Charles Nelson Brooks, Jr., 65, was formally charged Nov. 9 in Lincoln County District Court with feloniously pointing a firearm and assault and battery with a dangerous weapon.
Brooks also was charged with a misdemeanor of assault.
A $25,000 bond has been set for Brooks and he made his initial appearance on Dec. 2. On that date, Special Judge Emily Mueller ordered him to return with his attorney at 1:30 p.m. Feb. 24, 2022.
Count 1 against Brooks accuses him of on Oct. 23 in Lincoln County of pointing a pistol at Joe Lowery for the purpose of threatening or intimidating him.
The second felony charges him with on the same date trying to strike Joe Lowery with a baseball bat.
The misdemeanor count accuses him on the same date trying to strike Denise Lowery.
Chandler Police Officer Chris Hawkins states in a probable cause affidavit that shortly after 1 p.m. on Oct. 23 he was advised by his dispatch of a motorcycle followed by a Dodge pickup pulling a stock trailer occupied by a male who had pulled a gun on two motorcyclists.
He said he set up at 15th and Manvel Streets in Chandler to wait on the vehicles to pass so he could find out what took place.
Hawkins reported that both vehicles pulled into the Brick Hill gas station at 120 W. 15th and that he made contact with Brooks who jumped out claiming the couple on the motorcycle had attacked him. The officer asked Brooks where the gun was and he told Hawkins it was in the truck.
Hawkins said he advised Brooks to stay at the stock trailer while he made contact with the victims. The officer stated that as he was talking to Lowery and his wife, Brooks kept reaching inside the passenger side of his truck. He ordered Brooks multiple times to stay in his view.
“He disobeyed my command to stay out of the truck, pulling out a bat. I held him at gunpoint, then ordered him to put his hands behind his back.” Hawkins then placed Brooks under arrest and Lincoln County Deputy Cody Coleman reportedly transported Brooks to the Lincoln County Jail in Chandler.
Hawkins further talked to Lowery and his wife, discovering Lowery was an off duty Payne County deputy and the couple were on a motorcycle ride when they first encountered Brooks around 840 Road and 3430 Road.
The couple further detailed Brooks’ alleged actions for the officer and what led to them and Brooks pulling over at the gas station. Hawkins reported two guns and the bat
Hawkins reported two guns and the bat were taken to the Chandler Police Department for evidence.
