Luther man charged with first degree burglary

A Luther man has been charged with burglary, according to court documents.

District Attorney Adam Panter filed two charges against Tyler Don Brown, 34, of Luther, on May 20 -- one felony count of burglary in the first degree and one misdemeanor count of unlawful possession of drug paraphernalia, the filing said.

Brown made his initial appearance on May 28 and appeared again on June 25 for a pre-preliminary hearing. He will return to court on Aug. 20 for a preliminary hearing.

According to supplemental information, Brown has three prior convictions of unauthorized use of a vehicle in Lincoln, Garfield and Oklahoma counties.

On May 17, around 12:20 a.m., Dep. Greg Smith with the Lincoln County Sheriff’s Office was dispatched to a residence in Luther by the Communication Center after a woman called 911, stating that someone had broken into her house and was being held at gunpoint, according to the probable cause affidavit.

When Smith arrived at the home, he found a man and woman standing outside -- the woman was the resident of the home, while the man was a friend. The woman stated that the intruder was inside the house, being watched by her landlord.

Dep. Smith observed that a big glass window in the front door was busted, along with a smaller window. Upon entering the residence, he found the landlord in the kitchen, watching a man in a green jacket who was on the floor, identified as Brown, the affidavit said.

Smith handcuffed the man and took him to his patrol unit, where he was searched for weapons. He found a broken glass pipe that had a crystalline substance in it that Smith identified as methamphetamine. Brown was read his Miranda rights and refused to speak with law enforcement, the report said.

Dep. Smith spoke with the woman, who said she was in the den watching crime shows when she heard someone say “Please, help me.” At first, she thought it was part of the show, but then turned down the TV and realized someone was outside her house.At this time, the intruder began hitting the door, the affidavit said.

The woman called her friend, telling the man to get to her place right away. The man told her to get her gun, which was in her bedroom. As the woman reached the kitchen, the glass in the door broke, and Brown reportedly entered the house. He began to run at the woman with his arm up, and she stated that she asked him who hewasandwhyhewas there, the report said.

It was around this time that the landlord arrived and held Brown at gunpoint until the deputies could get there, according to the affidavit.

Brown was informed of his charges. After he was deemed medically fit for incarceration, he was transported to the Lincoln County Jail, the affidavit said.
