Third charge against Prague man

A Prague man already facing two felony charges has been charged with a third felony and a misdemeanor.

An original charge of Domestic Assault and Battery by Strangulation was formally filed against Alpha Randolph Woody, Jr., 60, on Oct. 22 in Lincoln County District Court with the Domestic Assault and Battery by Strangulation count.

He was arrested by Prague police and Lincoln County deputies.

Associate District Judge Sheila Kirk set bond at $3,000 with the stipulated condition that Woody have no contact with the victim.

She scheduled his initial appearance for Nov. 18, and on that date Special Judge Emily Mueller continued the matter until 1:30 p.m. on Dec. 2.

On Nov. 4, Woody was charged with knowingly receiving or concealing stolen property.

Special Judge Emily Mueller set his bond at $1,000 with an initial appearance for Nov. 4. On that date, she ordered him to reappear at 1:30 p.m. on Dec. 2.

In the most recent felony, Woody was charged in mid-December with another count of knowingly receiving or concealing stolen property and also possession of a controlled substance.

On those charges, he made his initial appearance before Associate District Judge Sheila Kirk on Dec. 20 and she set at $3,000 bond. He reappeared before her on Dec. 27 and then reappeared on Dec. 30 before Judge Mueller.

Judge Mueller has set a pre-preliminary hearing for Woody at 1:30 p.m. on Jan. 20 on each of the charges he is facing.

The most recent felony count accuses him on Dec. 10 in Prague of concealing speakers, saws and other miscellaneous items that had been stolen from Josh Dye.

The misdemeanor charges him on the same date of possession of marijuana without having a valid prescription or order from a practitioner.

In the Domestic Assault and Battery charge, Woody is accused of on Oct. 8 this year, at a residence in Prague, of committing battery and strangulation upon Harley Marie Hagar.

Prague Police Officer Josh Fry, in a probable cause affidavit, states he was dispatched to the Police Department for an individual requesting an officer. He says he made contact with Hagar and that her left eye was swollen with red and purple coloring.

Hagar told the officer she was at Woody’s residence visiting him and she and Woody had been drinking vodka.

In the affidavit, Hagar claims Woody drank a gallon of vodka. She reportedly told Woody she was going to leave with a friend and that was when he became irate.

The officer said Hagar advised him she walked out of the residence and that Woody came at her from behind throwing a half gallon almost empty Vodka bottle at her feet. She further told the officer the bottle did not hit her but she felt the liquid splash on the back of legs.

Woody then allegedly struck Hagar in the eye with a closed fist and grabbed her by the throat for two to five seconds. Hagar told the officer that Woody had what she described as a .25 caliber small framed pistol in the residence.

Hagar acknowledged to the officer she formerly had been in a dating relationship with the defendant, but was not currently in a relationship with him.

Fry states in the affidavit that based on Woody possibly being armed and heavily intoxicated that evening he requested assistance from the Lincoln County Sheriff’s Office. Fry and four deputies reportedly went to Woody’s residence.

The officer placed Woody in handcuffs once he opened the door andinitially he was transported to the Prague Municipal Jail before later being transported to the Lincoln County Jail in Chandler.

The second felony count filed against Woody accuses him on Oct. 25 in Prague of concealing a DeWalt 3000 PSI Power Washer that had been stolen from Delvin McClendon.

Prague Police Officer Jason Spearman in a probable cause affidavit reported he was dispatched on Oct. 25 to 1105 W. Ayars Ave. in Prague regarding a stolen power washer. Delvin McClendon told the officer that two power washers were missing from in front of his garage that morning.

The following morning, Oct. 26, the officer was dispatched to Davenport’s Archery Shop in Prague and on his arrival he observed a male and a female. Spearman said the male was Woody and the woman was Jennifer McClendon who advised him Woody had her power washer that she and her husband Delvin McClendon had reported missing.

The officer stated he took Woody into custody for the possession of stolen property and transported him to the Prague Municipal Jail. The power washer was returned to Delvin McClendon on the scene
