A Luther man has been charged with two felonies and two misdemeanors after allegedly discharging a firearm in a case investigated by Lincoln County deputies and other officers.
James Lee Macon, 65, was formally charged in Lincoln County District Court with felony discharging a firearm into a dwelling, malicious injury to property– over $1,000, also a felony.
The misdemeanor charges he faces are domestic abuse – assault and battery and carrying a firearm while under the influence of alcohol.
Special Judge Emily Mueller set his bond at $20,000 with the condition he have no contact with the victim.
His initial appearance is scheduled for June 2.
In Count 1, he is accused on April 20 in Luther in Lincoln County of discharging a firearm or other deadly weapon at or into a dwelling or any other building used for public or business purposes.
The second felony count charges him with on the same day of maliciously injuring a truck that belonged to Wesley Macon by hitting the truck that was blocking the driveway and causing a loss valued at more than $1,000.
The defendant, in one misdemeanor, allegedly assaulted Wesley Macon, his son, by hitting and kicking him with force and violence with the intent to injure him.
James Macon is also accused of carrying a .38 Special Revolver while he was under the influence of alcohol that would be sufficient to cause mental, emotional or physical processes to be affected to a degree that would result in abnormal behavior on his part.
Lincoln County Deputy Sheriff Steven Hinkle reported that on April 20 shortly before 11 p.m. he was dispatched to 970837 S. Rambling Oaks Drive in Luther in Lincoln County for a shots fired call.
The Communications Center advised him as he was en route that they could hear gunshots in the background.
County Deputy Sergeant Larry Stover, Jr., Deputy Investigator Tanner Hand, Deputies James Robinson, Mark Kelly, Wellston Police Chief Alf Hancock and Sac and Fox Officer Andrew Nguyen also responded to the call.
Wesley Macon, the reporting party, advised that his father had come home from a casino and assaulted him and that he was shooting at the house.
The Communications Center informed officers they could hear four or five gunshots. Wesley told Comm Center that no one had been hit as individuals had taken cover inside the residence as told to do by Comm Center.
After arriving, officers began their investigation. They discovered and collected at least two bullets from the front door of the residence.
