Guilty plea in firearms

A Sparks man facing a firearms charge after Lincoln County deputies served a search warrant where he was residing and guns and ammunition were seized has changed his plea to the count.

Gene Austin McCuan, Jr., 54, was formally charged in Lincoln County District Court on April 9, 2024 with possession of firearm after former felony conviction.

A $7,500 bench warrant was issued for his arrest at the time charges were filed. Court records show the bench warrant was returned and filed on April 23 and he made his initial appearance on May 2 before Special Judge Emily Mueller.

On Sep. 27, he waived his preliminary hearing. Appearing before District Judge Sarah Bridge for his arraignment, McCuan pleaded innocent.

During the felony disposition docket on Dec 17, appearing before Judge Bridge, as the result of a plea bargain McCuan withdrew his original plea and pleaded guilty.

The court found him guilty as charged and he was sentenced to five years in the Department of Corrections with all time suspended. He was fined $100, assessed a $100 VCA and court costs and ordered to pay 991 fees.

Judge Bridge also ordered McCuan to forfeit all firearms with the understanding that the firearms will be returned to the owner.

He was placed on supervised probation with the Oklahoma Court Services and ordered to report to the Probation Ovce and the Court Clerk's Ovce.

McCuan was accused on about March 19, 2024, of possessing a semi-automatic handgun located in his bedroom after he had been convicted in Oklahoma County District Court on Aug. 17, 2009 of possession of a Controlled Dangerous Substance.
