A bench warrant has been issued for the arrest of a Meeker man facing felony and misdemeanor charges.
Formal charges of first degree burglary, a felony, and assault and battery, a misdemeanor were filed Nov. 8 in Lincoln County District Court against Nicholas Shane Cagle, 28. A $15,000 bench was issued for his arrest on the same day the charges were filed.
In Count 1, Cagle is accused on Sep. 18, 2023 of breaking and entering into the dwelling house occupied by and in the possession of Deborah Hall in Lincoln County when she was there through the front door of the house, entering without her consent to commit a crime.
Count 2 charges Cagle on the same day of assault and battery of Hall by throwing a bag of concrete at the victim’s face with force and violence.
Lincoln County Sheriff Lt. Tony Long in a probable cause affidavit said he was contacted on Monday, Oct. 9, 2023 by Hall at the Sheriff’s Department about a burglary and assault that occurred on Sep. 18 in Wellston. She advised Long the Wellston Police Department responded the day of the incident but as of Oct. 9 no action had been taken and she requested the assistance of the Sheriff’s Office.
She related to Long that on Aug. 31, 2023 she had met with Cagle and contracted him to install a shower at her residence in Wellston.
She told Long a fee of $5,600 had been agreed on with an additional $150 up charge for a thicker layer of plywood on the floor.
Hall advised she issued a check in the amount of $2,950 and Cagle started the project on Sep. 4. He told Hall he would need to shut off the water for one day.
According to the affidavit, over the next nearly two weeks Cagle advised Hall he needed plumbing fixtures not included in the quoted amount which she went and purchased and then was told by him he found water damage that would require three additional 2X6 boards.
She provided Hall a shovel when he tried to dig the drain line with a hammer. She stated Cagle didn’t show up for work several days and had put down used decking which was unacceptable.
Hall informed the lieutenant on Sep. 18 was the date of the incident and Cagle entered her residence and eventually picked up a 40 pound bag of dry cement and threw it at her striking her in the face and eyes.
