Cushing man receives 7 years in jail, $100 in fines for burglary charges

A defendant facing several felony counts who was first arrested by Lincoln County deputies in late December in connection with burglaries, then again earlier this year, has pleaded guilty to all counts and been sentenced Tommy Nathaniel Tilley, 19, of Cushing was charged Dec. 28, 2023 in Lincoln County District Court with second degree burglary, knowingly receiving or concealing stolen property and possession of a sawedoff shotgun/rifle.

His pre-preliminary hearing was initially scheduled for March 21 on all three felonies. Special Judge Emily Mueller rescheduled it until April 11 in order for Tilley to hire private counsel and then moved it to May 23.

Appearing before District John Canavan for his arraignment, Tilley, as the result of a plea bargain. Withdrew his previous plea and pled guilty to second degree burglary. They judge received the plea, found him guilty as charged and sentenced him to seven years in the custody of Department of Corrections with balance to be suspended upon successful completion of R.T.P. or DOC equivalent.

He also fined him $100; handed him a $100 VCA, pay 991C fees and restitution is reserved for 30 days.

Judge Canavan ordered him placed him on supervised probation with DOC and he was told to report to the Probation Office and Court Clerk’s Office.

Tilley, as the result of a plea bargain, entered guilty pleas to Count 1, knowingly receiving or concealing stolen property and Count 2, possession of a sawed-off shotgun/rifle.

The judge received pleas on those charges and found him guilty as charged. On Count 1, he sentenced Tilley to five years and on Count 2 two years in the custody of DOC with the balance to be suspended upon successful completion of the R.T.P. program or DOC equivalent, a $100 fine, $100 VCA, pay 991C fees with restitution reserved for 30 days.

He was told to report to the Probation Office and Court Clerk’s Office.

On May 10 this year, Tilley was charged again with second degree burglary and on June 5, this year, another second degree burglary count was filed against him.

On the May 10 charge, still appearing before Judge Canavan, and as the result of a plea bargain, he entered a guilty plea. The judge handed him a seven-year sentence in DOC with the balance to be suspended upon successful completion of the R.T.P. program or DOC equivalent, a $100 fine, $100 VCA, pay 991C fees with restitution reserved for 30 days.

He was told to report to the Probation Office and Court Clerk’s Office.

On the June 5 count, as the result of a plea bargain, he entered a guilty plea. The judge handed him a seven-year sentence in DOC with the balance to be suspended upon successful completion of the R.T.P. program or DOC equivalent, a $100 fine, $100 VCA, pay 991C fees with restitution reserved for 30 days.

He was told to report to the Probation Office and Court Clerk’s Office.

The judge all the cases to run concurrent with each other. In the original burglary count, he was accused of breaking and entering a mobile home located in Avery, in Lincoln County on Nov. 27, 2023, by entering through a hole in the wall with the intent to commit a larceny.

The knowingly receiving or concealing stolen property count charged him on Dec. 21, 2023 of concealing a 4-wheeler, firearms and other miscellaneous items from an individual when he knew or had reasonable cause to believe they had been stolen.

The possession of sawed-off shotgun/rifle count accuses him on Dec. 21, 2023 of having in his immediate control a sawed-off shotgun with a barrel less than 18 inches in length/rifle with a barrel less than 16 inches in length.

Also charged in Lincoln County District Court on Dec, 28 is Aimee Desiree Moore, 45, of Cushing. She faces a charge of knowingly receiving or concealing stolen property, a felony, and possession of a Controlled Dangerous Substance, a misdemeanor.

She is also accused on Dec. 21, 2023 of concealing firearms, a wheeler and other miscellaneous items that had been stolen from the same individual that Tilley is charged with concealing them from.

The possession of CDS charges her with having methamphetamine on the same date.

She appeared before Judge Mueller on Dec. 22 who set her bond at $5,000. That was later reduced to $3,000.

Judge Mueller continued an appearance for April 11 and she was ordered to come with an attorney.

In the meantime, on May 16, she was charged again with possession of CDS. She was having a court appearance on both charges on July 2.
