Defendant sentences in pair of felonies

A man charged with drug trafficking, two other felonies and a misdemeanor has pleaded guilty and been sentenced Daniel Alejandro Cruz, 24 was formally charged in Lincoln County District Court on March 13, 2023 with trafficking in illegal drugs, possessing a firearm during commission of a felony and acquiring proceeds from drug activity, all felonies.

Appearing recently before District Judge John Canavan, Cruz, as the result of a plead bargain, entered entered guilty pleas to three of the four charges. The fourth count was dismissed without costs.

The court found him guilty as charged on Count 1 and sentenced Cruz to 10 years in the Department of Corrections with all time suspended except the first two years. He assessed the defendant a $25,000 fine with $20,000 suspended, $100 VCA and court costs.

On Count 2, the judge handed him a 10-year sentenced in DOC with all time suspended except the first two years, a $100 fine, $100 VCA and court costs.

The judge sentenced him on Count 3 to 10 years in DOC with all time suspended except the first two years, a $100 fine, $100 VCA and court costs. The judge ordered the sentences to run concurrent with each other.

Cruz also was ordered to obtain a drug and alcohol assessment and completed all recommended follow up treatment.

He is to pay 991 fees.

The defendant forfeits all proceeds from the arrest and was placed on supervised probation with DOC to be transferred to Tennessee. Cruz was ordered to report to the Probation Office within 30 days of his release and the Court Clerk’s Office upon his release.
