DUI charges filed in Lincoln County crash

A Tecumseh man was arrested and charged following a single vehicle collision recently on SH 102 in Lincoln County.

Formal charges of driving while under the influence of alcohol were filed in Lincoln County District Court July9 against Bryan Allen Day, 48.

His bond was set at $5,000 and he is scheduled to make his initial appearance on July 18.

The charge accuses Day on June 27 this year in Lincoln County of driving on a public road while under the influence of alcohol.

Supplemental information filed by Assistant District Attorney Kelly Trimble shows that Day was convicted in Oklahoma County District Court on Aug. 14, 2014 of driving while under the influence of alcohol, a misdemeanor.

State Trooper Conner Fryrear, in a probable cause affidavit, states he was dispatched on June 27 to a single vehicle collision that took place on SH 102, just north of 1020 Road in Lincoln County. He noted he observed a BMW in the south ditch with heavy front end damage.

Fryrear said as he began to speak to the driver identified as Day, who was leaning up against the vehicle, that he began by asking what happened and where he was coming from that evening.

Day reportedly told the trooper he was coming from OU Medical Center heading to Edmond. Fryrear advised Day he was traveling in the wrong direction if he was heading to Edmond.

The trooper asked the driver if he had anything to drink that night and Day replied he had plenty, telling him he had six plus beers.

The trooper later placed Day under arrest for DUI and Day agreed to the state’s breath test. He took Day to the McLoud Police Department, where he performed the state’s test with the results of 0.17 BrAC.

Fryrear then took Day to Saints in Shawnee for medical clearance, then transported him to the Lincoln County Jail in Chandler where he was booked.
