A Meeker man has waived his preliminary hearing and pleaded guilty to two felony charges and drawn deferred terms to run concurrently.
Charles Lee Green, 67, was formally charged Feb. 21 this year in Lincoln County District Court with aggravated eluding, driving a motor vehicle while under the influence of alcohol, both felonies and resisting an officer, a misdemeanor, for an incident that occurred in 2021.
Green made his initial appearance on March 9 before Special Judge Emily Mueller. She had scheduled his pre-preliminary hearing for May 11 but continued it until June 22. It was further continued until Aug. 24.
Appearing before Special Judge Emily Mueller, Green waived the preliminary heading. The state moved to dismiss Count 3, resisting an officer, upon payment costs.
As the result of a plea bargain, and pursuant to the state’s recommendation, Green entered guilty pleas on the aggravated eluding and driving a motor vehicle while under the influence of alcohol counts. The court received the pleas and found him guilty as charged on Count 1 and deferred sentencing for a period of two years, a $100 judicial assessment and court costs.
On Count 2, he also received a deferred sentence of two years, $100 judicial assessment, $100 VCA and court costs, with the sentences to run concurrently.
The judge further ordered him to perform 24 hours of Community Service, pay 991C fees; obtain an ADSAC and complete all recommended treatment.
Green is to attend a Victim Impact Panel, and he was placed on Supervised probation with Oklahoma Court Services.
He is to report to the Probation officer and Court Clerk’s Office to set up a payment plan.
In Count 1, aggravated eluding, Green was accused on Sep. 4, 2021 of increasing his speed in an attempt to elude Meeker Police Officer Raymond Mackin while driving at 1998 Chevrolet in the town of Meeker and Green had received a visual and audible signal and a red light and siren from Mackin.
Count 2 stated Green was driving and operating his vehicle on a public highway in Meeker while under the influence of intoxicating alcohol.
The resisting count against Green had accused him of resisting Mackin.
Supplemental information filed in the case by the District Attorney shows that Green was convicted on Sep. 8, 2006 in Pottawatomie County District Court of driving while under the influence of alcohol.
The incident on Sep. 4, 2021 led to Mackin being placed on administrative leave and a Review Board being set to determine if the officer used excessive force.
The Review Board determined the officer did not use excessive force as he was attempting to take Green into custody.
