A preliminary hearing has been rescheduled for a Chandler woman facing three felony charges, among them two for assault and battery upon a police officer, after her arrest.
Cheryl Manning, 46, was formally charged in Lincoln County District on Oct. 12, 2022 with two counts of assault and battery upon a police officer and placing bodily fluids on a police officer, all felonies.
She also was charged with drinking an alcoholic beverage in a public place.
She appeared before Associate District Judge Sheila Kirk on the day she was charged and ordered to make her initial appearance at 1:30 p.m. Nov. 10.
The judge set a $3,000 bond for Manning.
Special Judge Emily Mueller set her pre-preliminary hearing for March 16 and rescheduled it for April 13.
On April 13, she scheduled a preliminary hearing for Manning at 1:30 p.m. July 6. She has rescheduled that until 1:30 p.m. Sep. 28. Her bond remains at $3,000, the judge ruled, after Manning was returned to custody by a bondsman, court records show.
In Count 1, Manning is accused on Oct. 11 on the roadway near 930538 S. 3400 Road in Lincoln County of intentionally kicking Chandler Police Chief Matt Mattheyer while he was performing his duty to arrest her for being intoxicated in public.
Count 2 charges Manning on the same day and place of intentionally kicking Chandler Police Lt. Dax Phipps while he was attempting to arrest her for being intoxicated in a public place.
In Count 3, Manning is accused on the same day and place of spitting saliva on Phipps as he was trying to arrest her for public intoxication.
The misdemeanor charges her with drinking a Smirnoff Green Apple alcoholic beverage and being intoxicated at that same location.
In a probable cause affidavit, Lincoln County Deputy Sheriff Jimmy Brown stated he was dispatched to East 930 Road and South 3400 Road, one-half mile south of Chandler near the residence at 930538 S. 3400 Road shortly after 3:30 p.m. on Oct. 11 to a single vehicle crash.
He reported Comm Center advised the driver was intoxicated and when he arrived Mattheyer and Phipps had a female on the ground in handcuffs. He stated in the affidavit the female was yelling, screaming and cussing trying to get up saying she wanted to fight the two officers.
Brown said the vehicle was on its top when he arrived and Phipps asked Manning had she been drinking and she responded that she had. She told Phipps when asked how much, that she had too much to drink, according to the affidavit.
She acknowledged to Phipps she had consumed a six-pack of Smirnoff ice green apple.
Brown stated Deputy Christopher Hyde arrived on the scene and assisted him in putting Manning in the back of his patrol unit. Brown transported her to Lincoln County Jail in Chandler without incident.
