A pre-preliminary hearing has been scheduled for a Sparks man who faces four felony counts and two misdemeanors.
Formal felony charges were filed May 4 in Lincoln County District Court against James Leonard Smothers, 41 following his arrest recently by Lincoln County deputies.
Special Judge Emily Mueller scheduled the hearing for Smothers at 1:30 p.m. on Nov. 17. He appeared before her Sep. 15 and she ordered he return with his attorney on the new date.
A bench warrant had been issued for the arrest of Smothers who failed to appear for his court hearing on June 2.
Court records show the warrant was returned and filed on July 22.
His bond is set at $15,000.
In count 1, Smothers is charged with possession of firearm after former felony conviction of two or more felonies. On April 22, he allegedly had in his possession and control a 9mm semiautomatic pistol with a magazine containing eight rounds located in a crate after he had been convicted on Dec. 27, 2017, in Pottawatomie County District Court of possession of a stolen vehicle; knowingly concealing stolen property; and affixing improper license plate. Count 2 accuses Smothers of second degree burglary on the same date by breaking and entering into a building located at 349443 E. 1010 Road in Sparks. The information states the building was owned by Roger Baker which had property of value contained in it and was broken into with the intent to commit larceny.
In Count 3, Smothers is charged with grand larceny after former conviction of two or more felonies by taking and carrying away a storage building that belonged to Baker without his consent and with the intent to deprive Baker of a storage building permanently.
Count 4 against Smothers is injuring pipes or wires after former conviction of two or more felonies by cutting into the face plate to the box of an electric pole to attempt to connect into the power wires.
One misdemeanor count is trespassing without permission by trespassing on property at 349443 E. 1010 Road without the permission of the owner.
The other misdemeanor accuses Smothers of receiving, holding or concealing a lost or mislaid credit card belonging to an individual which was lost or mislaid and Smothers failed to inquire as to the true owner. He allegedly appropriated the debit card to his own use or the use of another without the permission of the owner.
Supplemental information filed by prosecutors for after former conviction of two or more felonies shows that Smothers was convicted on July 15, 2020, in Oklahoma County District Court of the misdemeanor offense of third degree forgery.
It also shows Smothers was convicted on June 17, 2015, in Pottawatomie County District Court of a felony of unauthorized use of a vehicle.
On the same day, in the same court, he was convicted of a felony of possession of a Controlled Dangerous Substance and unlawful possession of drug paraphernalia.
