A Meeker woman facing two felonies as a Lincoln County Deputy Sheriff suffered a broken leg as he attempted to arrest her while responding to a domestic disturbance has waived her right to a preliminary hearing.
Kaitlin Marie Frazier, 25, was formally charged in Lincoln County District June 29 with aggravated assault and battery upon a peace officer and assault with a dangerous weapon.
Frazier appeared before Special Judge Emily Muller July 25 who set her bond at $25,000. She made her initial appearance on Aug. 1 and her pre-preliminary hearing was held Aug. 15.
Appearing recently before Judge Mueller, she waived the 2 judge rule, entered no contest pleas as the result of a plea bargain, and waived a pre-sentence investigation.
Judge Mueller received the pleas, found her guilty as charged and sentenced her on Counts 1 and 2 to 10 years in the Department of Corrections. She fined her $50, assessed her a $50 VCA and court costs and ordered her to pay 991C fees.
The judge ordered restitution in the amount of $530, the balance to be suspended upon successful completion of RTP or equivalent program; a mental health evaluation and placed her on supervised probation with Oklahoma Court Services.
Her sentence is to run concurrent with a misdemeanor conviction of assault domestic abuse, assault and battery in which she entered a no contest plea, was found guilty by Judge Mueller and sentenced to one year in the County Jail with all of that time suspended.
She was fined $50, given a $50 VCA and court costs, and is to enter a Batterer’s Intervention program.
Frazier waived a 10-day detainer and a review is scheduled for Jan. 9, 2025. She is to report to the Court Clerk’s Office within 180 day of her release.
Assistant District Attorney Kelly Trimble prosecuted the cases and Frazier was defended by attorney Kimberly Miller.
Count 1 accused Frazier on July 24 of striking Deputy Steven Hinkle in the leg without justifiable or excusable cause, knowing Hinkle was a police officer who was performing his duties and Hinkle suffered a broken fibula.
In count 2, she was charged on the same day without justifiable or excusable cause of assaulting Traci Porter with a knife with intent to harm Porter.
In a probable cause affidavit, Lincoln County Sheriff Lt. Tanner Hand states Deputy Hinkle was dispatched to a domestic disturbance on S. 3450 Road in Meeker about 4:17 p.m. on July 24. Hinkle arrived at the scene about 25 minutes later. Due to statements by the reporting party and his previous knowledge of the suspect, Frazier, on his arrival he attempted to place her in investigative detention.
She began to resist him, striking him with her hands and feet.
Hinkle said he heard a pop in his right ankle and felt immense pain. Hinkle already had placed Frazier in handcuffs but she had not been secured.
Hand, contacted as the patrol supervisor, further stated that as he arrived on the scene Hinkle was being placed on a gurney and loaded into an ambulance. Hand reported he spoke with Meeker Assistant Police Chief Scott Wilson and Meeker Officer Kyle Crow about what they witnessed on their arrival.
Crow said he saw Hinkle sitting in the front yard of the address with Frazier lying supine, handcuffed. Crow told Hand he rolled Frazier over to her stomach and assisted her to her feet, then secured her in Hinkle’s vehicle.
Officers at the scene began collecting items Frazier dropped and found a silver pocket knife and what they believed to be a revolver in a black jacket previously worn by Frazier. The revolver turned out to be a starter gun and not a functioning firearm, Hand stated.
As the investigation continued, Hand spoke with Traci and Robert Porter who said as they returned home that day Frazier greeted them at the door and she was holding a knife. Traci reportedly told Frazier numerous times to put down the knife.
Eventually Traci called 911 after shutting a bathroom door and when Hinkle arrived, Traci and her husband left the residence and watched from the front porch.
