A man from Tryon is facing four counts, among them two felonies, following his arrest in April by Tryon police officers.
Formal charges were filed May 3 in Lincoln County District Court against Clayton Joseph Thomas Custard, 31.
The charges include two felonies, failure to register as sex offender and sex offender living within 2,000 feet of a school.
The misdemeanors are possession of controlled dangerous substance and obstructing an officer.
Special Judge Emily Mueller set a $5,000 bond for Custard with an initial appearance on May 7.
On May 7, she scheduled a pre-preliminary hearing for Custard at 1:30 p.m. June 3.
Count 1 accuses Custard of failing to register his address as 314 N. Oklahoma Street in Tryon as of April 20, 2021 when he had lived there more than three days.
He was convicted of second degree rape on Dec. 28, 2012 in Payne County, the charge states.
The second felony count states Custard was living within 2,000 feet of a park located at 314 Street in Tryon in Lincoln County on April 20 this year when prohibited by the requirements of the Oklahoma Sex Offender Registry Law.
In Count 3 against him, Custard possessed marijuana on April 20, this year, in Lincoln County.
Count 4 accuses Custard of giving a false name to Tryon Police Chief Billy Wilson on April 20, this year, delaying him in the performance of his duties.
