Stroud police arrested a man recently after they responded to a call concerning a reported domestic disturbance.
Formal charges were filed Aug. 11 in Lincoln County District Court against Travis Jacob Simon, 29, of Stroud. The felony charge is domestic assault and battery by strangulation and the misdemeanor count is for domestic abuse, assault and battery.
Special Judge Emily Mueller set a $10,000 bond for Simon with the condition he have no contact with the victim.
In Count 1, the felony, Simon is accused of committing an assault and battery upon a woman by strangling or attempting to strangle her with the intent to cause her great bodily harm.
Count 2, a misdemeanor, charges Simon with committing an assault and battery upon the woman by striking her about the head and body with his hands and fists.
Stroud Police Officer Charles Mash, in a probable cause affidavit, states he responded to a residence about 7:38 a.m. on July 15 concerning a domestic in progress and the suspect, Simon, was attempting to leave for work.
He says he contacted the victim and she advised Simon, attacked her, choked her by putting his hands around her neck and hit her in the side of the head.
Mash reported he observed while talking to the victim that on the left side of her head above the temple she had a large red mark consistent with being hit in the head.
The affidavit states she told the officer Simon was in the bathroom. The officer knocked on the bathroom door and he told Simon he was going to be arrested for domestic assault and battery by strangulation.
Simon claimed she started the fight and he only pushed her off of him.
He stated to the officer he had marks on his arms and back and the officer stated they appeared to be nail marks from the woman trying to get away from Simon.
Mash reported he arrested Simon without incident and transported him to the Lincoln County jail in Chandler where he was released to jail staff.
The officer noted two minor children were in the home at the time of the incident.
