Carney man waives speedy trial

A Carney man facing a felony and a misdemeanor charge has waived a speedy trial and his cause has been set for further disposition.

Formal charges were filed Oct. 26, 2022 in Lincoln County District Court against Joseph Dewayne Kalka, 35. They include felony domestic abuse by attempted strangulation and domestic abuse, a misdemeanor.

He was arrested following a reported domestic disturbance Kalka has entered a not guilty plea during his arraignment.

Appearing recently before District Judge Traci Soderstorm, she set his cause for 9:30 a.m. Aug. 8.

On March 14, Judge Soderstrom continued the case for further disposition until April 11 so that Kalka might obtain new counsel. The Judge stated that all previous orders remain in full force and effect.

On April 11, she continued the case until May 23 due to a funeral.

On Jan. 19, appearing before Judge Mueller, he waived his preliminary hearing and she scheduled his arraignment for January.

During his arraignment on Jan. 24 before District Judge Traci Soderstrom, he pleaded not guilty. Judge Soderstrom set the cause for further disposition at 9:30 a.m. on March 14.

Laura Kalka, the reported victim and his wife, filed for a Protective Order against him on Oct. 21. Judge Mueller issued an Emergency Protective Order on the same day and scheduled a hearing on Nov. 3.

The Protective Order was extended.

In Count 1, the felony, Kalka is accused on Oct. 19 at a residence on South 3380 Road in Lincoln County of strangling or attempting to strangle Laura Kalka.

Count 2, the misdemeanor, alleges Kalka struck his wife Laura about the head, face and body with his hands and fists.

Lincoln County Sheriff Sergeant Larry Stover, Jr., stated in a probable cause affidavit that he was dispatched to the Sheriff’s Office just before 9 p.m. on Oct. 19 to take a report from a female that was involved in a domestic disturbance.

He stated he talked with Laura Kalka who was distraught, had a raspy voice and had marks on her neck and redness on her left side of her head and bite marks on her left shoulder. She also was missing her right shoe, the sergeant said.

He said Laura explained to him what had occurred that evening at their residence after she and her kids returned home from church around 8 p.m.

Stover states in the affidavit that he went to the residence on on South 3380 Road and made contact with Joseph Kaka who Stover said was intoxicated. As they talked, Stover determined Kalka had a pistol on his hip and multiple pocket knives on him but didn’t want to talk about what had occurred between him and his wife earlier.

Stover placed Kalka under arrest for domestic in the presence of a minor child and domestic by strangulation.

The sergeant informed Kalka of his wife’s injuries and told Kalka he would see a judge in the morning.
