Maryland woman booked on drug charge

An out-of-state woman who faced a felony drug charge and four other misdemeanors, has pleaded guilty and received deferred terms on all five counts.

Autumn Renay Bennett, 37, of Baltimore, Md., was formally charged on Nov. 1 in Lincoln County District Court with distribution of a Controlled Dangerous Substance, including possession with intent to distribute.

Bennett also faced four misdemeanors including possession of Controlled Dangerous Substance, unlawful possession of drug paraphernalia, actual physical control of vehicle while under the influence and driving with suspended license.

Both the state and Bennett waived a pre-sentenced investigation.

District Court Judge Cindy Ashwood found Bennett guilty as charged on the felony of possessing marijuana, a CDS in Schedule 1 of the Uniformed CDS ACT of Oklahoma, with the intent to distribute and deferred her sentence for three years. She also gave her a $500 judicial assessment, a $200 VCA and court costs.

On Count 2 of possessing marijuana and not having a valid prescription or order from a practitioner, the judge deferred her sentence for one year, assessed her $100, gave her a $100 VCA and court costs and ordered she pay a $150 lab fee.

The judge, on each of the other misdemeanors including count 3, of possessing 2 medal spoons and a glass pipe which is used by abusers of drugs classified as CDS and without having any medical or other lawful need requiring possession of the paraphernalia, count 4 with actual physical control under the influence while in a Volkswagen at the same location while under the influence of Xanax which may render a person incapable of safely driving a motor vehicle, and count 5, with driving while her license to drive a motor vehicle was suspended by the Maryland Department of Public Safety, deferred her sentence for one year, gave her a $100 judicial assessment, $100 VCA and court costs with the sentences to run concurrent with each other.

Judge Ashwood also ordered Bennett to perform 40 hors of Community Service within six months, pay 991C fees and obtain a drug and alcohol assessment. She is to complete all recommended follow up treatment, the judge stated and attend a Victim Impact Panel.

She was to report to the Court Clerk’s Office by last Friday, Dec. 17.

Chandler police arrested her after they responded to the On Cue store in Chandler where two people reportedly were trying to sell drugs.

Chandler Police Officer Brent Berry stated in a probable cause affidavit he and Lt. Dax Phipps responded to the call about 9:40 p.m. Sunday, Oct. 24. Given the description of the vehicle the two subjects were to be in, he noticed a black Volkswagen beginning to back out from a parking spot and the license plate was close to a partial plate number that had been reported.

He stopped the vehicle in question and Lt. Phipps in his vehicle parked his unit and also approached the Volkswagen.
