Charges against Chandler man

A man was charged with two felonies and two misdemeanors following his arrest recently by Chandler police and he also admitted to taking meth.

Formal felony charges of first degree burglary and protective order violation were filed in Lincoln County District Court Jan. 14 against Gage Michael Smith, 28.

He also faces misdemeanor counts of resisting an officer and disturbing the peace while intoxicated.

Associate District Judge Sheila Kirk set his bond at $4,000.

He reappeared before Special Judge Emily Mueller on that date and she set his pre-preliminary hearing for 1:30 p.m. Feb. 24.

The first degree burglary charge accuses Smith of breaking and entering into the house occupied by and in the possession of Paige Castle in Chandler on Jan. 9. He allegedly forcibly pushed his way through the door and entered without the consent of the occupant with the intent to commit the crime of violation of protective order.

The protective order violation count states he bursted into the house and scared her children in violation of a final protective order that was issued June 23, 2020 by the District Court in Lincoln County.

In the resisting an officer charge, he is accused of obstructing Chandler Police Officer Tammi Batman by pushing back, yelling, screaming, tens ing up and attempting to kick out the window in the squad car.

He is also charged with being intoxicated and disturbing the peace at that residence in Chandler.

In an affidavit filed in the case, Batman reported she responded to a call regarding violation of a protective order. When she arrived at the residence, Castle informed the officer she had an active protective order against Smith and this was the third time Smith had violated the order.
