Seamster’s motion denied

A motion to dismiss a first degree murder charge against a Wellston man was denied Monday in Lincoln County District Court following a daylong evidentiary hearing.

District Judge Cindy Ashwood ruled there is sufficient conflicting evidence for the case to be tried as she denied the motion filed by attorneys for Freddie Antonie Seamster.

Seamster, at the time 38, is accused of fatally shooting 21-year-old Lucas Goss with a firearm in Lincoln County on July 5 last summer.

Even though Seamster had been bound over to stand trial, and District Judge Cindy Ashwood has scheduled his trial for June, the judge had set a hearing on the motion to dismiss and a discovery conference for Monday.

On Jan. 18, the Judge Ashwood ordered the cause set for the felony disposition docket at 9:30 a.m. on May 17 and the jury trial on June 6.

She originally scheduled the motion to dismiss and discovery conference for March 8. That was continued.

The judge has advised Seamster the murder charge is an 85 percent crime.

Seamster has claimed he shot Goss in self-defense.

He was formally charged in Lincoln County District Court on July 12.

Lincoln County Sheriff’s Capt. Chuck Brewer, who headed up the investigation, has said an argument over property reportedly led to the shooting death of Goss.
