A felony charge of child abuse filed against a McLoud man has been dismissed.
The charge was filed March 24 in Lincoln County District Court against CW Buffalo Arpoika, 42 following his arrest by Lincoln County deputies last month.
Last week, as a preliminary hearing was about to start, the state announced it was dismissing the case without cost, meaning the charge could be refiled at a later time.
On May 26, the case was dismissed and the order filed.
On March 31, District Judge Cindy Ashwood scheduled a pre-preliminary hearing for him on April 21.
On April 21, Special Judge Emily Mueller set the matter for preliminary hearing on May 26.
The charge accused Arpoika on March 17 of injuring C.A., who was 16 years old at the time and failing to protect him from harm.
Lincoln County Sgt. Larry Stover, Jr., states in an affidavit that he was dispatched to a residence on South Parkwood Meadow Drive, McLoud, in Lincoln County around 3:16 a.m.
He said the 911 call came in as a 911 open line and that Comm. Center informed him a male kept telling the dispatcher to shut up and listen.
The dispatcher reportedly could hear nothing and began asking follow up questions to see what the emergency was. The caller kept yelling.
Stover noted that Deputy Christopher Hyde arrived and began speaking with C.A. who was barefoot and out of breath saying that his father, CW Arpoika, had been chasing him around the yard saying that he was going to kill him.
According to the affidavit, Deputy Kevin Chapman also arrived and he and Stover knocked on the front door. CW was in the house and Stover said he was severely intoxicated and upset.
Deputy Hyde took C.A to his patrol unit to separate the two until deputies could further determine what was happening.
Stover reported as he walked towards Hyde’s patrol unit, Hyde advised him C.A. was also severely intoxicated and had injuries to his right arm and back.
Hyde related to Stover that C.A. told him CW had thrown him against the wall.
Stover told Deputy Chapman to transport CW to the Lincoln County Jai and Deputy Hyde to take C.A. to the Sheriff’s office and that he, Stover, would call DHS to meet them there.
