Six charges dropped; five refiled

Six charges, one felony and five misdemeanors, filed after Stroud police arrested a driver during a traffic stop, have been dismissed and the five misdemeanor counts refiled.

Formal charges were filed April 7 in Lincoln County District Court against Daniel Frank Kozlowski, 43, of Bristow.

A $5,000 bond was originally set for Kozlowski and his initial appearance was on Apr. 28. Special Judge Emily Mueller scheduled a pre-preliminary hearing for May 12 and on that date set the cause of Aug. 5.

Court records show that on June 24 the state moved to dismiss all of those charges and on the same day filed the five misdemeanors. His initial appearance on those charges was set for Aug. 5.

On that date, Judge Mueller scheduled the matter for Sep. 2.

The felony charge filed against Kozlowski that was dismissed was for unlawful possession of a controlled drug with intent to distribute.

He was accused on April 2 of possessing marijuana as a classifi ed Schedule 1 controlled dangerous substance at SH 99 and the Turner Turnpike in Lincoln County with the intent to distribute.

The misdemeanors include: Count 1, possession of a controlled dangerous substance, a misdemeanor, charges him on the same day of having methamphetamine, classified as a Schedule II CDS.

In Count 2, also a misdemeanor, he is accused of unlawful possession drug paraphernalia by possessing a meth pipe used by abusers of drugs classified as controlled dangerous substances and without having any medical or other lawful need requiring the paraphernalia.

Count 3 charges Kozlowski with obstructing driver’s view by driving a passenger car on SH 99 and the Turner Turnpike while there was windshield obstruction on the front windshield that obstructed a clear view of SH 99 and the turnpike.

In Count 4, he is accused of operating a vehicle with the license plate covered with the intent to hide the number of the license plate.

The fifth misdemeanor accuses Kozlowski of failure to maintain insurance or security while wrongfully driving and operating the vehicle.
