A Stroud man has pleaded guilty to a pair of felony charges including one for allegedly striking a Lincoln County Deputy Sheriff.
Formal charges were filed June 29 in Lincoln County District Court against Jesus Daniel Fraire-Aguero, alias Jesus Daniel Aguero, 34.
The felonies include possession of contraband by an inmate and assault and battery on a police officer.
Associate District Judge Sheila Kirk set bond in a combined amount of $8,000. Aguero made his initial appearance on July 7 before Special Judge Emily Mueller and she scheduled a prepreliminary hearing on Aug. 18.
However, in July, Aguero appearing before District Judge Cindy Ashwood, waived both his pre-preliminary hearing and preliminary hearing. On the state’s recommendation as a result of a plead bargain, Aguero pleaded guilty to both counts.
The judge found him guilty on both charges and handed him five-year suspended sentences on each count, assessed him $300 fines on each charge and ordered a $100 VCA on each charge.
She said the sentences are to run concurrent with each other.
The judge ordered Aguero to complete an ADSAC and complete all followup treatment; complete a 90-day in-patient treatment program; perform 40 hours of Community Service with nine months; he was advised of mandatory registry on the methamphetamine registry and he was placed on supervised probation with Oklahoma Court Services.
In Count 1, he was charged on June 24 of bringing methamphetamine, a controlled dangerous drug, into the Lincoln County jail.
Count 2 accused Aguero on the same day of striking Deputy Sheriff Mark Kelley without justifiable or excusable cause.
Kelley, in a probable cause affidavit, stated that Kimberly Aguero called and said her soon to be exhusband was attempting to gain entry into the house.
Dispatch advised the deputy that Aguero had a valid warrant in Lincoln County. As Kelley arrived, Aguero was coming out of the house and the deputy ordered him to put his hands on the wall.
The deputy handcuffed him. Kimberly advised the deputy that Aguero was high on meth.
After arriving at the Lincoln County Jail in Chandler, Deputy Kelley reported the jailers had trouble getting Aguero into the front detox unit and he went to assist. Kelley said he became combative and that he and three or four jail staff put him into a cell.
Kelley stated afterwards he sustained several small cuts to both hands.
