A Luther man has pleaded guilty to one felony count and drawn a deferred term. Three others charges have been dismissed. charged with two felonies and two misdemeanors after allegedly discharging a firearm has waived his right to a preliminary hearing and an arraignment has been scheduled.
James Lee Macon, 65, was formally charged in Lincoln County District Court with felony discharging a firearm into a dwelling, malicious injury to property– over $1,000 also a felony.
Macon appeared recently before District Judge CindyAshwood for his arraignment. The state moved to dismiss counts 3, 4 and 5 as the result of a plea bargain agreement and he pleaded guilty to Count 2, malicious injury to property over $1,000.
Judge Ashwood found him guilty on that count and handed Macon a three-year deferred sentence. She gave him a $500 judicial assessment, $200 VCA and court costs; ordered him to perform 40 hours of Community Service within six months; pay 991C fees; a three month extension to determine any restitution.
He was placed on supervised probation with Oklahoma Court Services. Restitution status was set for March 14, 2023. The court ordered Counts 3, 4 and 5 dismissed without costs and he was told to report to the Probation Office and the Court Clerk’s Office.
The misdemeanor charges he faced were domestic abuse–assault and battery and carrying a firearm while under the influence of alcohol.
After Macon and the state waived his right to the preliminary hearing, Special Judge Emily Mueller scheduled his arraignment for 9 a.m. on Dec. 20.
