Prison term for Sparks man

A Sparks man, who during the first week of January waived his right to a preliminary hearing, has pleaded guilty and been handed prison terms on each of three felony counts.

Brandon Allen Walker, 43, was formally charged in Lincoln County District Court on Oct. 7 with second degree burglary, unauthorized use of a vehicle and possession of firearms after a prior felony conviction.

Walker appeared before Special Judge Emily Mueller on Oct. 4 and she set his bond at $5,000. Walker made his initial appearance on Oct. 13 before Judge Mueller.

On Jan. 5 he appeared before Judge Mueller and waived his right to a preliminary hearing.

She set his arraignment for Jan. 10.

Appearing before District Judge Traci Soderstrom for his arraignment, Walker entered guilty pleas to each of the charges as the result of a plea bargain.

Judge Soderstrom received the pleas. Both the state and Walker waived the pre-sentence investigation.

On Count 1, second degree burglary, the judge sentenced Walker to five years in the Department of Corrections, assessed him a $100 fine, a $100 VCA and court costs.

On Count 2, unauthorized use of a motor vehicle, she gave him four years in the Department of Corrections, a $100 fine, $100 VCA and court costs.

On Count 3, possession of a firearm after felony conviction, she handed him five years in DOC, a $100 fine, $100 VCA and court costs. She ordered the sentences to run concurrent with each other.

Walker was given credit for time served.

He was ordered to report to the Court Clerk’s Administrator within 180 days of release.

Count 1 accused Walker on about Oct. 3 of breaking and entering into a house located on South 3430 Road in Lincoln County belonging to Sherry Nicely and Keith Nicely with the intent to steal property.

In Count 2, unauthorized use of a vehicle, Walker was charged on the same day of taking and using a Ford Escape motor vehicle belonging to Sherry and Keith Nicely with the intent to deprive the owners of the vehicle either temporarily or permanently.

Count 3 accused Walker on the same day of possessing a rifle and shotgun after he was previously convicted of a felony.

Supplemental information filed by prosecutors shows that Walker was convicted in Lincoln County District Court on Nov. 18, 2015 of second degree burglary and knowingly concealing stolen property, both felonies.

Lincoln County Deputies Kevin Roe and Jimmy Brown along with Investigator Christopher Hyde were involved in the investigation.

Hyde stated in a probable cause affidavit that he arrested Walker and took him to the Lincoln County Jail.
