Guilty pleas in two cases

A Stroud man charged twice in 13 days with felonies has pleaded guilty in both cases.

Formal charges of unlawful possession of a controlled drug with intent to distribute were filed Sep. 13, 2023 in Lincoln County District Court against Ronald Dean Mixon, 60.

On Sep. 26, 13 days later, the new felony and misdemeanor counts were filed in Lincoln County District Court. They included unlawful possession of a controlled drug with intent to distribute and with driving with license cancelled/ suspended/ revoked.

Earlier, Mixon had entered innocent pleas in the cases and had been scheduled for jury trials next month.

Recently, during a felony disposition docket before District Judge John Canavan, Mixon, as the result of a plea bargain, enter guilty pleas. The judge received the pleas, the state and Mixon waived a pre-sentence investigation and the court found him guilty.

Judge Canavan placed Mixon in the Lincoln County Drug Court program and ordered that he is to complete all rules and conditions of that program. If he successfully completes the program, the judge states, the cases will be dismissed.

If he is unsuccessful, the judge stated Mixon will be sentenced to 10 years in the Department of Corrections on the first case. Judge Canavan, on the second case, placed him in the Drug Court program with the same stipulation that if he completes it successfully, that case, too will be dismissed.

If unsuccessful, he will be sentenced to 10 years in DOC on Count 1 of the case and one year in the Lincoln County Jail on Count 2 of the case. The sentences in the two cases are to run concurrent with one another.

The judge ordered Mixon to report to the Lincoln County Drug Court program.

On the first charge he appeared before Associate District Judge Sheila Kirk and she set his bond at $10,000. He made his initial appearance on Sep. 21.

On the newest charges, a $7,000 bench warrant was issued and returned and filed the same day they were filed.

Assistant District Attorney Rachel Thompson filed supplemental information showing that Mixon was convicted on Feb. 2, 2017 in Creek County District Court of felony concealing stolen property.

In the case filed Sep. 13, Deputy Sheriff Christopher Hyde, who is an investigator, states in a probable cause affidavit that he responded shortly before 3 p.m. Sep. 5 to a Stroud residence after he was contacted by Oklahoma Court Services Probation Officer Melissa Johnson who told him she had completed a home visit compliance check on Mixon who was on probation and that she had located narcotics in his vehicle.

She advised Hyde that when she arrived at Mixon’s residence he was not there, but a short time later he showed up in his pickup truck. Mixon reportedly allowed her entry into the home and she located a green leafy substance and digital scale.

She gained permission then to search Mixon’s vehicle and she located narcotics and paraphernalia tucked under the driver’s seat, according to the affidavit.

A container with two plastic bags was located that resembled methamphetamine. Two cellular phones were also found and turned over to Hyde.

The investigator later transported Mixon to the Lincoln County Jail in Chandler.

In the counts filed on Sep. 26, Mixon is accused of possessing methamphetamine and or marijuana on Sep. 18, 2023 at 821 W. Main in Stroud in Lincoln County.

The misdemeanor charges him with operating a red Ford F-150 while his license was suspended.

Once again it was Deputy/ Investigator Hyde who spotted Mixon driving eastbound on Elm Street from Highway 99 and Hyde states in a probable cause affidavit he knew Mixon’s license was suspended.

He made a traffic stop on Mixon and smelled the odor of marijuana emitting from his vehicle. Hyde located drugs in the vehicle, he stated in the affidavit.

Hyde had a wrecker service take possession of the vehicle and impound it.
