Man makes initial appearance for aggravated DUI

ACushing man is heading to a pre-preliminary hearing for aggravated DUI and carrying a firearm while intoxicated, according to court documents.

Jackie O’Kelley, 45, of Cushing, was charged on May 19 by District Attorney Adam Panter with one felony count of driving a motor vehicle while under the influence of alcohol, aggravated, and one misdemeanor count of carrying a firearm while under the influence, according to the filing. O’Kelley made his initial appearance on May 21 and returns to court on July 23 for a pre-preliminary hearing.

According to the probable cause affidavit, on May 11 at around 10:40 p.m., Oklahoma Highway Patrol Trooper Patrick Ball was on patrol on Interstate 44 near Chandler when he was dispatched to a collision on Highway 66 near the intersection of South 3540 Road in Stroud.

When he arrived, two Lincoln County deputies were already on scene. Ball inspected the accident and then spoke with the driver, who identified himself as O’Kelley. The trooper asked O’Kelley to get his insurance information, and while he retrieved that, Ball observed a pistol mounted to the lower dash to the right of the steering wheel, the report said. He asked the driver if he had any other weapons, to which O’Kelley said he had another pistol in his front right pants pocket. Ball retrieved and secured both pistols while having O’Kelley sit in the front passenger seat of his patrol unit, the affidavit said.

As the driver explained what happened in the collision, Trooper Ball noticed the odor of alcohol and that O’Kelley had slurred speech. He asked if he could perform a field sobriety test, and O’Kelley consented. The driver did not pass the test. Ball had him return to the front passenger seat while he got a preliminary breath device. O’Kelley refused the test. The trooper then placed him under custodial arrest for aggravated DUI collision and possession of a firearm while under the influence of alcohol, the affidavit said.

After being medically cleared at Saint Francis in Bristow, O’Kelley was transported to the Lincoln County Jail without issue.
