A man from Shamrock, Okla., faces two felonies and a misdemeanor following his arrest by a Lincoln County deputy and an Agra police officer.
Jack Lee Weems, 32, was formally charged in Lincoln County District Court with unauthorized use of a vehicle, possessing firearm during commission of a felony and eluding/attempting to elude a police officer.
The eluding charge is a misdemeanor, the other two counts are felonies.
Weems appeared before Associate District Judge Sheila Kirk on Dec. 29, 2020 and she set bond at $5,000. He was ordered to appear before Special Judge Emily Mueller on Jan. 28.
But due to COVID exposure, the initial appearance was continued until 1:30 p.m. on Feb. 18, court records show.
Count 1 against Weems accuses him of unauthorized use of a vehicle by using a GMC truck owned by Becky Hutchinson without her permission on Dec. 26 in Lincoln County.
Count 2 charges him with possessing a .380 Taurus pistol while in the commission of the unauthorized use of a motor vehicle on that same date.
Count 3 alleges eluding by accelerating when signaled to stop by Deputy James Robinson on SH 18 in Lincoln County on that same date in an attempt to avoid arrest.
In a probable cause affidavit, Robinson states he was advised by Agra Officer Brad Jackson that a vehicle had just been stolen from the convenience store within Agra city limits. Jackson informed the deputy the truck left heading north on SH 18.
Robinson said he was in Agra at the time and he and Jackson headed north on the highway and caught up to a vehicle matching the description south of 740 Road on SH 18 in Lincoln County.
The deputy gave dispatch the tag number and advised he believed this was the stolen vehicle.
In the affidavit, he further states he observed the truck drift to the right off the road and then drift over into oncoming traffic.
Robinson reported he activated his emergency lights to perform a traffic stop just south of 740 Road. The vehicle slowed slightly and then accelerated. He activated his siren and advised dispatch he was in pursuit of the truck.
The deputy said he reached speeds around 85 to 90 miles an hour. As the truck attempted to make a right turn going east on Eseco Road in Payne County, it struck a concrete drainage ditch and left the road to the north. The vehicle came back onto the road accelerating to go eastbound on Eseco.
It began to fishtail, left the gravel to the north, striking a tree, Robinson reported.
He and Jackson chased the suspect on foot, the suspect ran into a tree and fell down and they caught up with him placing him in custody.
The suspect reportedly had a holster on him. Robinson stated he found a gun at the back of the vehicle on the ground.
Cushing EMS was called and took Weems to the Cushing Hospital. Deputy Christopher Hyde followed the ambulance to Cushing and later transported Weems to the Lincoln County Jail.
