Not guilty in OnCue shooting

A Lincoln County jury has found two Texas men not guilty of all charges related to a shooting at the On Cue in Stroud more than three years ago.

The State Attorney General’s Office filed charges in October of 2021 in Lincoln County District Court against Jeffrey Lee Battey, 57 at the time, Ponder, Texas and Ray Arnold Allen, 52, at the time, Krum, Texas, in connection with the shooting which occurred Oct. 9. 2021.

The Oklahoma State Bureau of Investigation was in charge of the investigation. The State Attorney General’s Office was in charge of prosecuting the case.

After deliberating for about three hours, the jury returned and announced not guilty verdicts on all of the counts against both Battey and Allen.

At the conclusion of a preliminary hearing in July of 2022, both were bound over to stand trial.

Court records show Battey was standing trial on a single count of assault and battery with a dangerous weapon.

Another count had been dismissed by the state prior to the trial which began on Monday, Oct. 28 and finished shortly before midnight Friday, Nov. 1.

Allen was standing trial on counts of assault with a dangerous weapon and accessory after the fact. According to court records, two other charges had been dismissed by the state.

His trial was held at the same time as Battey’s before the same jury.

Assistant Attorney Generals Heather Anderson and John McKenzie McMahan prosecuted the case for the state and Battey and Allen were represented by defense attorneys Robert Robles and David Smith.
