Arraignment delayed due to winter weather

The scheduled arraignment for a Chandler couple charged with sex-related crimes to a minor following their arrest by Lincoln County deputies has been postponed due closure of the courthouse because of the recent wintry weather conditions.

Formal charges were filed in Lincoln County District Court on Sep. 21 against Destiny Ann Lowe, 39, and her husband Robert Wayne Lowe, 41.

Originally, Robert Lowe faced four counts of lewd acts to a child under 12 years old and Destiny Lowe was charged with a single count of enabling child sexual abuse.

At the conclusion of their preliminary hearing on Jan. 20, they were bound over. Their arraignments had been scheduled for 9:30 a.m. on Jan. 31. But the courthouse was closed that day.

On Feb. 1, District Judge Traci Soderstrom continued the arraignment until 9:30 a.m. on Feb. 21.

Court records show that Robert Lowe now faces a total of seven counts of lewd acts with a child under 16 and Destiny Lowe is facing one count of enabling child sexual abuse and one count of lewd acts with a child under 16.

Robert Lowe was charged with fourth degree arson and Destiny Lowe had been granted an EPO against Robert Lowe. Court records show the EPO was dismissed by Special Judge Emily Mueller at Destiny Lowe’s request.

His fourth degree arson charge was dismissed on Jan. 20.

Robert Lowe appeared before Associate District Judge Sheila Kirk on Sep. 12 and she set his bond at $50,000.

Special Judge Emily Mueller scheduled his prepreliminary hearing for 1:30 p.m. on Oct. 13.

Destiny Lowe appeared before Judge Kirk on Sep. 16. The judge set her bond at $50,000.

She made her initial appearance before Special Judge Emily Mueller on Sep. 22. Judge Mueller scheduled her pre-preliminary hearing for 1:30 p.m. on Oct. 13.

On that date, Judge Mueller set the matter for each of them for 1:30 p.m. on Nov. 17. She continued their hearings until Dec. 15.
