A Davenport man has been arrested by Lincoln County deputies and charged with a felony after he refused to allow them into a residence to check on two children.
Curtis Lee Allen Russell, 35, was formally charged earlier this monthinLincolnCounty District Court with child neglect. He appeared before Associate District Judge Sheila Kirk who has set his bond at $9,000.
She scheduled his initial appearance for June 27.
Russell is accused on June 1, 2024 of committing the crime of child neglect as a person responsible for children’s health, safety or welfare who maliciously neglected his18-month-old children B.R. and S.R. by failing to provide adequate shelter.
The information alleges the children were living in a home littered with trash, human feces and insects at 116 E. Frisco in Davenport.
In a probable cause affidavit prepared by Lincoln County Deputy Kevin Chapman, he states he was informed that Chandler Police Officer Sara Saunders had been investigating an incident that had occurred within the Chandler city limits.
He further stated it involved Russell and SummerWilsonandtheir two sons.
According to the affidavit, Russell allegedly had been harassing and stalking Wilson at her place of business. He reportedly had the two children in the vehicle with him and was intoxicated and driving recklessly.
Chapman states he was shown a video that showed Russell leaving Wilson’s place of business and nearly wrecking it into a pole.
Saunders had responded to Russell’s residence at 116 E. Frisco attempting to follow up on her investigation.
Chapman noted that Saunders informed him she was able to speak briefly with Russell but he would not allow her to perform a welfare check. He had claimed the children were asleep inside the residence.
In the affidavit, it states DHS was contacted by officers and a referral was made regarding the children’s safety. A DHS worker responded and met with officers and Russell at that point would no longer answer the door.
An emergency pickup order was granted for the two children. DHS requested assistance in locating the children and enforcing the order.
Other deputies responded to the residence, Chapman stated.
He met with Sheriff Charlie Dougherty and other deputies and discussed the situation and options, then talked with Detective Larry Stover who maintained contact with Judge Kirk. Chapman was informed that by authorization of the Judge’s order they were to check the welfare of the two children by necessary means.
Chapman said he and other deputies approached the front door of Russell’s residence while Sheriff Dougherty maintained a visual on the only other door of the residence.
After knocking loudly several times with no response, Chapman stated a forced entry was made into residence where he spotted Russell standing behind furniture he’d used to barricade the front door. Chapman ordered Russell to exit the residence while other deputies cleared the residence, locating the two children in their cribs.
The children appeared to be okay, the deputy stated.
Chandler EMS was requested to check out the children and upon further examination discovered several insect bites on their bodies.
Chapman transported Russell to the Lincoln County Jail in Chandler where he was booked.
