Hearing set in felony DUI case

By Mike McCormick Staff Writer A pre-preliminary hearing has been scheduled for a Stroud man with previous felony convictions who was recently arrested and charged with a new felony.

Walter T. Banks, 67, was charged in Lincoln County District Court April 15 for driving while under the influence of alcohol, a felony.

He appeared before Associate District Judge Sheila Kirk the day he was charged and she set his bond at $3,000. He made his initial appearance for April 18.

His pre-preliminary hearing has been scheduled for 1:30 p.m. June 6.

The charge states that on April 8, this year, Banks was driving at motor vehicle on a public road while under the influence of alcohol.

In a probable cause affidavit, Iowa Tribal Police Officer Marcos Sanzon states while on patrol at the Ioway Casino he observed a gray pickup truck without a license plate exit the Casino and head east on Highway 66. The officer said he observed the driver throw a blue container out of the passenger side window containing an unknown liquid.

Sanzon reported he conducted a traffic stop at Highway 66 and 3390 Road. He said that location is within the jurisdiction of the Iowa Tribe of Oklahoma.

The officer stated he eventually arrested Banks for driving while intoxicated at that location.

Supplemental information filed in the case by Assistant District Attorney Adam Kallsnick shows Banks has been convicted of at least two felonies and two misdemeanors.

On April 3, 1981, in Tulsa District Court he was convicted of first degree murder.

He was convicted in Muskogee County District Court on Oct. 25, 1900 of the felony offense of possession of contraband in a penal institution while an inmate.

On Aug. 24, 2020, he was convicted in Canadian County District Court of aggravated driving a motor vehicle while under the influence of alcohol, a misdemeanor.

Bank was convicted on March 22, 2022 in Cleveland County District Court of aggravated driving while under the influence of alcohol, a misdemeanor.
