A motorist faces a felony and two misdemeanors after he was arrested following a collision on SH 99 in Lincoln County.
Jose Castellanos Figueroa, 40, was formally charged in Lincoln County District Court recently with driving while under the influence of intoxicating liquor, a felony.
He also was charged with the misdemeanors of driving without a valid driver’s license and unlawfully transporting an open container of alcoholic beverage.
Associate District Judge Sheila Kirk set his bond at $3,000 and scheduled his initial appearance for 1:30 p.m. on March 3.
The DUI charge accuses him of driving while under the influence of alcohol by operating a 2000 Toyota Tacoma on SH 99 on Jan. 27 this year.
The no driver’s license count charges him with driving without first obtaining a valid, color photo Oklahoma’s driver’s license.
And the unlawfully transporting an open container of alcohol count accuses him of transporting four cans of beer that had been opened and from which the original cap had been removed, making it accessible to him as he was operating his vehicle.
State Trooper Barrett Karlin, in an arrest report, said he was advised of a single vehicle rollover crash on SH 99 and 1030 Road about 6:15 p.m. on Jan. 27. He stated as he arrived, he could see a Toyota pickup truck in the east ditch of SH 99 on the driver’s side.
He said he spoke with EMS and firemen on the scene and they told him the driver was in the back of the ambulance. As the trooper spoke with Figueroa he could smell an odor of alcohol, he noted.
Figueroa, when asked how much he had to drink, put up four fingers. He refused medical treatment, the trooper stated.
Karlin had to hold onto Figueroa to keep him from falling as he helped him back to his patrol unit, he said.
The trooper reported he first transported Figueroa to Stroud Hospital to get the driver medically cleared, then took him to the Lincoln County Jail in Chandler where he was booked on the charges.
