A driver from Wellston arrested in July on a felony charge of driving under the influence of alcohol has pleaded guilty and has been given a deferred sentence.
Donald Gene Barnett, 51, was arrested by State Trooper Barrett Karlin on July 3.
On July 9, Barnett was formally charged in Lincoln County District Court with DUI.
On Aug. 12, Barnett and the state waived his right to a preliminary hearing. Special Judge Emily Mueller set his arraignment for 9:30 a.m. on Sep. 7.
Appearing before District Judge Cindy Ashwood on that date, Barnett pleaded guilty on that charge as the result of a plea bargain agreement. Judge Ashwood handed Barnett a two-year deferred sentence on the DUI charge and assessed him a $100 fine, $100 in VCA and court costs.
On the failure to maintain insurance or security by driving his vehicle without a security verification form, the judge deferred sentencing for two years, ordered a $100 judicial assessment, and a $100 VCA and court costs.
She also deferred sentencing for two years on a charge of driving with license cancelled, suspended, revoked by operating his vehicle while his license was suspended by the Oklahoma Department of Public Safety. The judge ordered a $100 judicial assessment, $100 VCA and court costs.
The sentences are to run concurrent with each other, the judge ruled.
Barnett was ordered to attend a Victim’s Impact panel, complete an ADSAC assessment and complete all recommended followup treatment. He is also to perform 40 hours of Community Service within six months.
The judge dismissed a charge of speeding in excess of the lawful maximum limit, by traveling at a speed of 88 miles per hours on Highway 66 in Lincoln County where the speed limit is posted at 65 miles per hour which he exceeded, the trooper had stated.
He was placed on supervised probation with the Oklahoma Court Services, was to report to the Probation Office and Court Clerk’s administrator within 10 days of his release from custody.
He had faced a felony DUI due to state prosecutors filing supplemental information showing Barnett was convicted on April 15, 2014, in Pottawatomie County District Court of driving while under the influence of alcohol and given a one-year suspended sentence.
The charge accused Barnett of driving and operating a motor vehicle on Highway 66 in Lincoln County while under the influence of alcohol.
