Helms charged with second degree burglary

Wade Garett Helms, 22, of Luther OK was charged on July 20 with Burglary in the 2nd degree and knowingly receiving or concealing stolen property.

Mitchel Lee Helms was charged on July 20 with the same charges, Burglary in the 2nd degree and knowingly receiving or concealing stolen property.

According to the police report filed by Detective Larry Stover, on June 23, Deputy Allen Brown was dispatched to the location of the victim, Wesley Cochran.

Cochran told officer Brown that unknown individuals broke in to his shop and stole various items. This included a small yard tractor, a Lincoln welder, cutting torch, and an air compressor.

“Wesley stated his property had a fence and a locked gate,” Detective Stover said in the affidavit. “When he discovered the burglary, he had checked his gate and found the lock open.”

Wesley then went on to explain to Detective Larry Stover that his stolen air compressor was found on the north side of his property and because of this, the detective found tire tracks leading to 1010 Road.

“This location [was] in the area of SW Neighborhood watch. I contacted Charlotte Rose with the SW Neighborhood watch,” Detective Stover said in the affidavit.

Rose possessed video surveillance of 1010 Road. Later that day Rose contacted the detective and informed him she found a truck going east down 1010 Road at approximately 11:09 p.m., according to the affidavit.

Detective Stover then went to make a copy of the tape showing the vehicle leaving the scene.

On the way to Charlotte Rose’s residence, Detective Stover spotted the truck that matched the description of the one in the video and ran the tag number.

“I followed the truck because it was a vehicle that matched the brief description of the vehicle Charlotte Rose had described,” stated Detective Stover in the affidavit.

He then followed the truck to the residence of an individual named Kristopher Riggs.

“I then proceeded to the residence of Charlotte Rose. I arrived and she provided the video which shows the newer red four-door truck that was missing from the back gate… The truck in the video was the same truck that was at Kristopher Riggs’ residence,” Detective Stover said in the affidavit.

In the video there were three visible subjects. At approximately 3:20 p.m. Detective Stover went to the Kristopher Riggs residence.

“I asked Kristopher who was the owner of the red Ford truck,” Detective Stover said in the affidavit. “Kristopher stated the owner was Mitchell Helms and he was in the house… Mitchell came out of the house and asked me why I needed to talk to him.”

Detective Stover then asked Mitchell few questions regarding the truck and asked if he had loaned his truck to anyone lately. Mitchell responded that he had just gotten the truck and it has been in Midwest city on jacks.

“I told Mitchell that he was lying about not being on Lincoln County on (the day of the Burglary),” Detective Stover said in the affidavit.

At that time Detective Stover read him his Miranda rights. Mitchell told Detective Stover that it was not his truck and that he had not been in Lincoln County until that day.

Mitchell Helms then became verbally aggressive towards Detective Stover, according to the affidavit.

Detective Stover spoke with Wade Garrett Helms who was also in Kristopher Riggs’ house. He is Mitchell’s brother. He also stated that they had been in Midwest city until the day of the detective questioning him.

Malcolm McKinney was in the same house at that time and his story was the same as the two brothers’.

Kristopher Rigg’s brother Kane Meyn was best friends with the Helms brothers and McKinney for what he claims as being most of his life.

Kane stated that the two brothers stayed at his girlfriend’s house two nights ago, on the night of the burglary.

When asked about possibly having seen the stolen trailer or property Kane said he didn’t know anything about it.

Kane claimed to live with his girlfriend Virginia Mize.

Detective Stover arrived at her residence and noticed a trailer that had been pulled by Mitchell’s in the front yard.

Virginia Mize stated that the brothers had stayed the night at her house Monday night. When asked about the trailer she stated that Mitchell had dropped it off at her house that morning.

Mize stated during Monday night they would leave and come back multiple times.

The VIN number on the trailer had been removed and he trailer was impounded, according to the affidavit.

Later that night Detective Stover discovered the VIN number to the trailer and it came back stolen from a man in Harrah named Bobby Wayman, according to the affidavit.

The trailer was returned to him and the brothers were charged.

Initial Bench warrant was issued on July 20 for Wade Garrett helms and Mitchell Lee Helms.
