Tucker Ray Messer, 29, of Stroud, was charged with battery on a police officer, resisting arrest and public intoxication.
According to the affidavit filed by Stroud Police Officer Christopher Hyde, Hyde was on a routine patrol when he saw a man stumbling as he was walking and trying to hide something in his left hand.
Hyde recognized the man as Messer from previous contacts with him.
According to the affidavit, Hyde witnessed Messer sway back and forth and almost fall down, when Hyde asked him how much he had to drink, Messer never responded.
Messers eyes were red and bloodshot, his speech was slurred and his inability to stand without stumbling led Hyde to determine he was publicly intoxicated, according to the affidavit.
When Hyde told him he was under arrest and asked him to place his hands behind his back, Messer refused and said, “I could just headbutt you and take off,” according to the affidavit.
Hyde cuffed the left wrist, but when he went to cuff the right, Messer began to pull away.
According to the affidavit, Messer kicked Hydes the inside of his leg, while aiming for the groin, and threw his head back in an attempt to headbutt Hyde.
Hyde performed a leg sweep and took Messer to the ground where he had a better advantage and handcuffed Messer.
Messer filed his $2,000 bond and will be back in court May 7 at 1:30 p.m. for his pre-preliminary hearing.
