A preliminary hearing has been scheduled for a Meeker man who was charged in February of this year for an incident that occurred in 2021.
Charles Lee Green, 67, was formally charged Feb. 21 this year in Lincoln County District Court with aggravated eluding, driving a motor vehicle while under the influence of alcohol, both felonies and resisting an officer, a misdemeanor.
Green made his initial appearance on March 9 before Special Judge Emily Mueller. She had scheduled his pre-preliminary hearing for May 11 but continued it until June 22.
She has set his preliminary hearing for 1:30 p.m. on Aug. 24.
In Count 1, aggravated eluding, Green is accused on Sep. 4, 2021 of increasing his speed in an attempt to elude Meeker Police Officer Raymond Mackin while driving at 1998 Chevrolet in the town of Meeker and Green had received a visual and audible signal and a red light and siren from Mackin directing him to stop his vehicle.
Count 2 states Green was driving and operating his vehicle on a public highway in Meeker while under the influence of intoxicating alcohol.
The resisting count against Green accuses him of resisting Mackin by not allowing him to complete his duties of arresting him.
Supplemental information filed in the case by the District Attorney shows that Green was convicted on Sep. 8, 2006 in Pottawatomie County District Court of driving while under the influence of alcohol.
The incident on Sep. 4, 2021 led to Mackin being placed on administrative leave and a Review Board being set to determine if the officer used excessive force.
The Review Board determined the officer did not use excessive force as he was attempting to take Green into custody.
