Davenport man pleads guilty

A Davenport man has pleaded guilty for assaulting his brother by attempting to strangle him.

Formal charges of domestic assault and battery by strangulation were filed in Lincoln County District on April 19, this year against Thomas Jay Northcutt, 45.

Appearing recently before Special Judge Emily Mueller, Northcutt waived his preliminary hearing and he waived the two judge rule.

On the state’s recommendation and as the result of plea bargain, Northcutt pleaded guilty. He waived a pre-sentence investigation.

Judge Mueller found him guilty as charged and sentenced Northcutt to two years in the Department of Corrections with credit for time served, assessed him a $100 fine and $100 VCA and court costs. She noted Marsy’s Law was complied with. He waived the 10-day rule and was ordered to report to the Court Clerk’s Office upon his release.

Northcutt was accused on April 14 this year of committing an assault and battery by strangulation or attempted strangulation against Phillip Northcutt, his brother, by choking him.

In a probable cause affidavit, Lincoln County Deputy Sheriff Kevin Chapman states he responded to a residence on North Broadway in Davenport where he was met by Phillip Northcutt who told Chapman his brother Thomas Northcutt had pushed him out of his wheelchair and choked him.

Chapman noted that Phillip stated his brother Thomas will get up nearly everyday and verbally assault him and his father. Phillip advised the deputy that day was no different other than Thomas had physically assaulted him.

Thomas Northcutt was not on the scene at that time and Phillip further advised Chapman that Thomas must have left because his pickup was gone.

A little while later, after Chapman had left, the Lincoln County Communications Center contacted him and advised William, their dad, had called in to let him know Thomas had returned home.

Chapman said he and Deputy Ty Wiseman responded back to the residence in Davenport. They took Thomas Northcutt into custody and transported him to the Lincoln County Jail in Chandler where he was booked and processed without further incident.
